Why a homeowner or other mortgagor in NY and other judicial-foreclosure states should stop paying the mortgage if financial difficulty is expected in 6 months, invite a foreclosure action, defend the action timely and vigorously (at low cost), and use the extended time to obtain a reasonable modification agreement or find a buyer to get any of your equity out of the property (by not having to sell at a distress sale).

Try this scenario. You bought a house 3 years ago for $ 500k. You put down $ 200k. Today your same house across your street sold for $ 175k. You still OWE $ 300k on your house. Would you STILL make your payment?..knowing you LOST your entire life savings of the down payment and still underwater $ 125k? Who is to be blamed? The Bank should take at least half the blame…for lending out money to people with zero money down, and no credit..driving up prices in the first place.

I immediately contacted my bank in writing requesting a 4 to 5 month loan deferment & papers were sent to me but it took 5 months to get them, my employer of 3 + years filed bankruptcy while in hospital & fail to pay social security & other benefits & taxes, bank changes their mind on deferment places me in loss midigation, informing me I’m now 3 months in rears facing foreclosure any good attorney in CT ?
